1. Acceptance of Terms

By accessing or using ISP2Go's ISP management platform, website, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms.

2. Definitions

  • "Services" means all of ISP2Go's cloud-hosted ISP management platform services, including billing and invoicing, customer relationship management, network management, ticketing, scheduling, inventory tracking, APIs, and all related tools and applications.
  • "Customer" means an Internet Service Provider, network operator, or other organisation that subscribes to ISP2Go's platform services.
  • "Partner" means a Customer who operates as a reseller or white-label operator using ISP2Go's multi-tenant platform.
  • "Subscriber" means an end user of a Customer's ISP services whose data is managed through the ISP2Go platform.
  • "Visitor" means any person browsing the ISP2Go website without an active account.
  • "Platform Data" means all data entered into, generated by, or processed through the ISP2Go platform, including customer records, billing data, network configurations, tickets, and reports.

3. Platform Services

ISP2Go provides a comprehensive cloud-hosted ISP management platform including:

  • Billing & Invoicing: Automated invoice generation, payment processing, tariff plan management, and financial reporting.
  • Customer Management: Subscriber CRM with profiles, service history, document storage, and communication logs.
  • Network Management: Router monitoring, IP address management, bandwidth control, RADIUS integration, and network topology visualisation.
  • Support & Ticketing: Ticket lifecycle management, SLA tracking, staff assignment, and customer communication.
  • Scheduling: Field technician scheduling, job management, route planning, and task tracking.
  • Inventory: Equipment tracking, serial number management, stock locations, and asset lifecycle.
  • Lead Management: Sales pipeline, lead tracking, conversion analytics, and follow-up scheduling.
  • Multi-Tenant Architecture: Partner/reseller support with tenant isolation, sandbox environments, and white-label capabilities.

4. Account Registration

Account Creation

To access ISP2Go's platform, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

Account Security

You are responsible for safeguarding your login credentials. You must immediately notify us of any unauthorised use of your account or any other breach of security. You are fully responsible for all activities that occur under your account.

Organisation Accounts

If you create an account on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms, and your agreement to these Terms will be treated as the agreement of the organisation.

5. Acceptable Use Policy

You agree not to use the Services to:

  • Violate any applicable laws, regulations, or third-party rights.
  • Transmit harmful, threatening, abusive, harassing, defamatory, or objectionable content.
  • Impersonate any person or entity or misrepresent your affiliation.
  • Interfere with or disrupt the Services, servers, or connected networks.
  • Attempt unauthorised access to the Services, systems, or networks.
  • Send spam, unsolicited messages, or engage in harassment through platform communication tools.
  • Reverse engineer, decompile, or disassemble any part of the Services.
  • Use the Services for cryptocurrency mining or resource-intensive operations unrelated to ISP management.
  • Exceed rate limits or circumvent usage restrictions.
  • Share login credentials with unauthorised parties.
  • Build a competing ISP management platform using ISP2Go's Services.
  • Store or process data that violates applicable data protection regulations.

6. Data and Platform Usage

Platform Data

You retain ownership of all Platform Data you enter into the Services. By using our Services, you grant us a limited, non-exclusive, royalty-free licence to process, store, and transmit your Platform Data solely to provide the Services.

Data Export

You may export your Platform Data at any time using the export tools provided within the platform. We will assist with data migration upon reasonable request when you terminate your account.

Data Processing

When the Services process data on your behalf (e.g., subscriber records), ISP2Go acts as a data processor. Our processing is governed by the ISP2Go Data Processing Addendum.

Subscriber Data Responsibility

As a Customer, you are responsible for ensuring that your collection and use of Subscriber data through the ISP2Go platform complies with all applicable data protection laws, including obtaining any required consents from your Subscribers.

7. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your Personal Data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to the collection and use of your information as described in our Privacy Policy.

8. Payment Terms

Subscription Plans

Services are offered through various subscription plans based on subscriber count, feature access, and usage tiers. By subscribing to a paid plan, you agree to pay applicable fees as described on our pricing page.

Billing

  • Subscription fees are billed in advance on a monthly or annual basis as selected during subscription.
  • Charges may be based on subscriber count or usage tiers.
  • Overage charges may apply if you exceed your plan limits.
  • All fees are non-refundable except as expressly stated in these Terms.
  • Pricing may change with 30 days' advance notice.
  • Failed payments may result in service suspension or termination.
  • You are responsible for all taxes associated with your use of the Services.

Free Trials

Free trial periods may be offered for certain plans. Free trials have usage limitations and automatically convert to paid subscriptions unless cancelled before the trial period ends.

9. Intellectual Property Rights

Our Rights

The Services and all materials therein, including software, APIs, documentation, images, text, graphics, logos, patents, trademarks, service marks, copyrights, and other intellectual property, are owned by ISP2Go (Tyga.Cloud Ltd) or our licensors and are protected by intellectual property laws.

Your Rights

You retain ownership of any data, content, or records you create using our Services. By using our Services, you grant us a limited, non-exclusive, royalty-free licence to process and transmit your data solely to provide the Services.

Licence to Use Services

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable licence to access and use the ISP2Go platform solely for the purpose of managing your ISP operations.

Feedback

Any feedback, suggestions, or ideas you provide to us regarding the Services may be used by us without any obligation to compensate you.

10. Service Level Agreement

Uptime Commitment

For paid plans, ISP2Go commits to maintaining 99.9% uptime for our core Services, measured monthly. Uptime excludes scheduled maintenance windows and circumstances beyond our reasonable control.

Performance Standards

  • Platform response times under normal load conditions.
  • Real-time network monitoring with minimal latency.
  • Automatic failover and redundancy systems.
  • Scheduled maintenance windows with advance notice.

Service Credits

If our uptime commitment is not met, you may be eligible for service credits as outlined in our detailed Service Level Agreement document, available upon request for enterprise customers.

11. Disclaimers and Limitations

Service Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ISP2GO (TYGA.CLOUD LTD) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Maximum Liability

Our total liability to you for all claims arising from or relating to these Terms or the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

Service Dependencies

While we maintain robust infrastructure, the ISP management platform depends on various factors including internet connectivity, third-party service availability (payment processors, email providers), and network conditions. We cannot guarantee uninterrupted service due to factors beyond our control.

12. Indemnification

You agree to indemnify, defend, and hold harmless ISP2Go (Tyga.Cloud Ltd) and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, your use of Subscriber data, or your infringement of any intellectual property or other rights of any person or entity.

13. Termination

Termination by You

You may terminate your account at any time by following the account closure process in your account settings or by contacting our support team.

Termination by Us

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms, exceed usage limits, or engage in prohibited activities.

Effect of Termination

Upon termination, your right to use the Services ceases immediately. We will provide a reasonable period (30 days) for you to export your Platform Data. After this period, ISP2Go may delete your account and all associated data, though we may retain certain information as required by law or for legitimate business purposes.

14. Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Arbitration

Any dispute arising from these Terms or your use of the Services shall be resolved through binding arbitration in accordance with the rules of the London Court of International Arbitration (LCIA).

Class Action Waiver

YOU AGREE THAT DISPUTES BETWEEN YOU AND ISP2GO WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

15. General Provisions

Changes to Terms

We may modify these Terms at any time. If we make material changes, we will provide you with advance notice through email or platform notifications. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

Entire Agreement

These Terms, together with the Privacy Policy, Cookie Policy, and any applicable Data Processing Addendum, constitute the entire agreement between you and ISP2Go regarding the use of the Services and supersede all prior agreements and understandings.

Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

Force Majeure

We shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemics, or government actions.
